Which rule allows compensation beyond assigned 1.5 acres land?
I have been assigned only 1.50 acres of DKT land as per the Assignment Committee and DKT registers. However, the RDO has paid ex-gratia compensation for 4.00 acres during the alienation of my land for a public purpose. Am I entitled to receive ex-gratia compensation for the entire 4.00 acres? Can the RDO unilaterally determine that I am in possession of the excess 2.50 acres of land? There is a gap of 22 months between the date of assignment and the date of award. Can this period be considered as long-standing possession?
You are legally entitled to compensation only for the 1.50 acres assigned to you. The extra 2.50 acres will not be considered unless you have official proof of long-term, lawful possession. A 22-month gap is not enough to claim ownership. You can appeal to the District Collector or High Court with strong evidence to seek full compensation.
