How can I claim compensation after car accident?

My leased car met with an accident due to the fault of another driver and was declared a total loss. It was a major accident, and I am still suffering from trauma and back pain issues. My insurance company paid me ₹2 lakhs towards the repair/claim amount. The lease period was almost over, and I was planning to purchase the car at the end of the lease. Since the accident occurred due to the other driver’s fault, can I still file a court case to recover the value of my car and claim compensation? Ultimately, I lost my car. Please advise.

Dear Client, Yes, you can file a Motor Accident Claims Tribunal (MACT) case against the at-fault driver and ask for the full vehicle value, along with medical expenses, trauma related compensation, and compensation for pain. Also, the insurance payment of ₹2 lakhs usually doesn’t stop you from pursuing further claims, it does not bar additional claims in the way people often assume.
