To get anticipatory bail under Section 354B of IPC before an FIR is filed, one has to make an application for the same to the High Court or Sessions Court and must be available under Section 438 of Criminal Procedure Code. The applicant needs to show his reasonable belief that they must be arrested for a non-bailable offense of criminal force with intent to disrobe a woman. Among them are the nature of the accusation and the applicant's past conduct, which make the court consider granting bail-that is, a suspect can be released on arrest and is not immediately detained.
