Can I file both bounced cheque cases in one thana?

Sir, I received two cheques from a man as repayment for a ₹10 lakh loan—each cheque for ₹5 lakh. Both cheques bounced, one from Salempur bank and the other from Baitalpur bank. Since both banks fall under different police station areas but are in the same district (Deoria), can I file a complaint for both cheques at the same police station?

Dear Client, Yes, this is recommendable. You can file a complaint regarding the dishonour of both the cheques at any one police station within the Deoria district. Though the cheques are drawn on 2 different banks, the provisions of the criminal procedural laws in India allows the investigation of offences committed partly in one place and partly in another, by the police. This is also substantiated by the fact that the cheques have been issued as part of the same transaction, that is, for repayment of the loan worth 10 lakh. I hope this answer helps. In case of future queries, please feel free to contact us. Thank you.

Cheque bounce is a court matter under Section 138 NI Act. You must first send a legal notice within 30 days of dishonour. If no payment is made in 15 days, file a complaint in court. If both cheques were deposited in the same bank branch, one complaint is enough; otherwise, separate complaints are needed. For further legal assistance contact us on our helpline number.
