How can I resolve loan case filed in Kolkata?

I am in Tamil Nadu and have taken a personal loan from Kotak Bank in Chennai branch, Tamil Nadu. However, due to loan default, they have filed a complaint case in Kolkata, making it impossible for me to appear, and they are continuing to harass me by phone. They have filed a case under the BNS Act, stating that I made false commitments to induce them to provide me with the loan and that the offense occurred in their Kolkata branch within their jurisdiction. But I have been in Tamil Nadu, signed the loan agreement at the Chennai branch, and paid nearly 15 installments. I don’t know how to handle this issue since I am in Tamil Nadu and cannot appear in person in the Kolkata court. Can anyone guide me on what to do?

You can request the court in Kolkata to transfer the case to a local court in Tamil Nadu, as the offense occurred in Tamil Nadu. You should consult a lawyer in Kolkata or Tamil Nadu to file an application for this transfer. For further legal assistance contact us on our helpline number.
