Is it legally punishable if someone harasses after loan repayment?

We had taken ₹6 lakh from a relative long back, and since then we have already repaid ₹9.45 lakh with transaction records. There was never any written agreement or proof from their side. Now, during our difficult time, they are harassing us and sending abusive texts.

In India, harassment by a lender or recovery agent, even after a loan is repaid, is a legally punishable offense under both criminal and civil law. Such actions violate guidelines from the Reserve Bank of India (RBI), as well as consumer protection laws and provisions of the Indian Penal Code (IPC). While defaulting on a loan is a civil matter, the use of coercive or abusive tactics by recovery agents constitutes a criminal offense. A police complaint can be filed.

If you are still being harassed or abused by your relatives with regard to this loan amount, their conduct is unlawful. You may file a police complaint for harassment and criminal intimidation under Sections 351 and 352 of the Bharatiya Nyaya Sanhita, 2023.
