Can Association disconnect water for flats not paying charges?
Corporation supply drinking water to the apartment complex who collect the water in tanks and supply the water to individual flats. Association paying water charges to Corporation. Some flat owners not paying proportionate water charges to the Association for the water consumed by them. Can we disconnect the individual water connection to the defaulting flats? If the association fails to remit the water charges to the corporation, corporation will disconnect the water connection.
Dear Client, No. Though the apartment association has the right to collect water charges from individual owners, it doesn’t give them the right to unilaterally disconnect water supply, an essential service, to the flats that default in paying the charge. The same would amount to unlawful deprivation and will be flagged by the authorities. I hope this answer helps. In case of future queries, please feel free to contact us. Thank you.
Yes, the Association can disconnect or restrict water supply to flats that don’t pay their share, but only after giving proper notice and following fair process. However, some basic water supply for essential use should still be provided. It is best to check your Association rules and take legal advice before acting.
