Do I have rights in my deceased uncle’s property?
My uncle had two self-earned houses in his name. Recently, my uncle passed away, and a few months later, his only son also passed away. My uncle's wife (the son's mother) has also passed away. My uncle's son was married, but they had no children. Now, the parents of my uncle's daughter-in-law are planning to get her remarried. My question is: As the sons of my uncle's brothers, do we have any legal right or share in my uncle’s property?
we need to look into succession act. first of all, we need to know to which community you belong to and what act will come into play. if you are a Hindu, hindu succession act to be followed; and uncle means, in english everyone is addressed as uncle. Kindly visit a lawyer to know the options.
Your uncle’s house was self-earned. Since his wife, son, and mother have all passed away, and the son’s wife is still alive, the property legally goes to her. As his brother’s son, you do not have a direct right to the property unless she gives it up or a will says otherwise. It is advised to consult an expert lawyer who will assist you with the beast course of action. For further legal assistance contact us on our helpline number.
