Can bank file FIR or suit after DRT dismissal?
I am an employee of a Regional Rural Bank since 15-02-1983 and was terminated on 14-03-2008. Our case is still pending in the High Court. I retired on 31-12-2021. I had an Overdraft Loan (ODL) account with the bank, which became inoperative in 2007. The bank filed an OA (Original Application) in DRT Lucknow in 2017 for recovery. In 2021, DRT dismissed the OA. Can the bank now file a civil suit or an FIR against me for this ODL account? The loan was sanctioned properly for ₹4,00,000 by the Regional Office. At NPA status, the balance was ₹6,50,000, and the bank filed an OA for around ₹11,00,000 including interest. My Provident Fund (PF) is still pending with the bank. I’ve requested them to release my PF and close the loan, but bank officials are only willing to settle the dues without releasing the PF. I cannot pay this amount. What should I do if they file an FIR?
If DRT has dismissed the bank's case, they may try filing a civil suit, but filing an FIR is unlikely since it's a civil debt, not a criminal matter. You're entitled to your PF. Send a legal notice demanding PF release and settlement. Don’t sign any unfair settlement. Consult a banking or service lawyer immediately.
