Can a company hold a reliving letter?
I had a 3-year service agreement with a private limited company, where I worked as a Process Engineer. I completed 2.5 years, including a 3-month notice period, which I served before resigning. My question is: Can the management withhold my relieving letter or demand compensation even after I served the full notice period? I only want my relieving letter, not the experience letter. The reason for my resignation is to pursue an MBA, which I clearly mentioned in my resignation letter. I have returned all company assets and also have a copy of my resignation letter signed by my manager.
If you served your full notice period, returned all company property, and have no dues, the company cannot legally hold your relieving letter. Your reason for leaving is valid, and your manager’s signed resignation copy supports your case. You can send a written request, and if ignored, file a complaint with the Labour Commissioner or send a legal notice. For further legal assistance contact us on our helpline number.
