Can I challenge my cancelled Section Engineer promotion after restructuring?
Respected Sir/Madam, On 03/11/2003, I was the only candidate called for one Section Engineer vacancy reserved for the SC category on 17/11/2003 (date of the written exam). At that time, I was working as a Junior Engineer. I appeared for the exam, but on 26/04/2005, I received a letter from the division stating: “In view of the vacancy position having been changed as a result of restructuring, the selection process conducted earlier prior to the restructuring of the cadre is cancelled with the approval of the concerned authorities.” However, in other divisions, candidates were promoted on 01/11/2003, and one of them was from the same division, citing RBE 177/2003
You may file a representation to the Divisional Railway Manager citing Articles 14 and 16 of the Constitution for denial of equal opportunity, as others were promoted under RBE 177/2003. If unresolved, approach the Central Administrative Tribunal (CAT) under the Administrative Tribunals Act, 1985 seeking restoration of your selection and promotion with consequential benefits.
