Can I get revised relieving letter without negative remark?
I joined ABC Company in 2014, which has a 90-day notice period with a buyout option. After COVID, the buyout option was removed. They now require serving the full 90-day notice or accept a negative remark on the resignation letter. I applied to other companies, but none were willing to wait 90 days. After working for almost 10 years, I decided to join a new company after serving only 30 days' notice. I informed ABC HR via email that I had two months of earned leave available and was willing to pay, but I was unable to serve the full notice period. However, they did not agree. Due to financial reasons, I joined the new company. After five months of follow-up, I received the relieving letter from ABC, but it included a negative remark: "Unprofessional Exit." Now, other companies are rejecting my application due to this remark. Can I request a revised relieving letter from ABC? I have email proof and screenshots that I served 30 days' notice.
Since you served 30 days' notice and offered leave adjustment with proof, you can send a legal notice to ABC Company asking them to remove the negative remark. If they don’t respond, you may send a legal notice and file a complaint with the Labour Commissioner. You have the right to fair treatment after 10 years of service. Legal support will strengthen your case. For further legal assistance contact us on our helpline number.
