Can my school withhold experience letter during a pending police investigation?

My school lodged an FIR against me on 31 March 2026, alleging that I downloaded more than 2,000 files from the school's Google Drive using the school email ID. It has now been more than 120 days, but no charge sheet has been filed. I have repeatedly requested my salary slips, Form 16, experience letter, and relieving letter. The school issued my salary slips and Form 16 only after multiple requests. However, it has refused to issue my experience and relieving letters, stating that they are waiting for the police investigation report to determine whether I downloaded the 2,000 files. What legal remedies are available to me?

If no charge sheet has been filed and the school is withholding your experience and relieving letters solely because of the pending investigation, you may send a legal notice requesting their issuance. If the school still refuses without valid legal grounds, you may approach the appropriate labour or education authority, or seek appropriate relief before the competent court.
