How to claim unpaid wages?
I joined Blupin Technologies Pvt. Ltd. (Mylo) on 19 January 2026 as a Performance Marketing Associate and worked there until 3 February 2026. On 4 February, I informed my manager via WhatsApp that I would not be continuing with the organization because I did not see suitable personal and career growth opportunities. At that time, due to a family emergency, I was unable to visit the office to return the company laptop, so I sent it through my cousin, which was acknowledged by the team. Later, when I asked about my salary for the days I worked, the company refused to release it and marked me as absconded, stating that I did not follow the formal resignation process. However, I had already informed them and returned the company property. Additionally, my UAN was linked with the company, and PF contributions were deposited. Despite sending emails and contacting HR, they have refused to release my salary for the days I worked. I would like to know my legal options to claim my pending wages.
Dear Client, An employer cannot legally withhold wages for the period an employee has actually worked. Under Section 17 of the Code on Wages 2019 employees must receive their wages for work completed while Section 18 demands that employers make payment within the designated wage timeframe. The employee whose wages have been wrongfully withheld has the right to present a claim at the authority designated by Section 45 of the Code on Wages 2019 to recover unpaid wages which include compensation. Evidence such as appointment emails, WhatsApp communication, and PF records may be produced as documentary evidence under Sections 61 and 63 of the BSA 2023 to establish employment and the period worked.
You have the legal right to receive salary for the days you actually worked. First, send a written legal notice to company demanding payment of your pending wages with proof of WhatsApp communication and laptop return. If they still refuse, you can file a complaint with the Labour Commissioner Office under the Payment of Wages Act, 1936.
