Can sister claim job or force land division legally now?

My wife was appointed to a Telangana government job on compassionate grounds after her father’s death in 2014, with the full agreement of all family members, including her unmarried second sister. She applied within the required time and officially joined in 2023, despite being married at the time. She now lives with and takes care of her mentally ill mother and manages her pension. The second sister, who initially supported the appointment, is now demanding that she resign so she can claim the job, and is also pressuring for the immediate division of their mother’s 7.5-acre land, which is solely in the mother’s name. She is threatening to file a case against her job if she does not sign for the land registration.

As per the prevailing laws regarding compassionate appointment in Government employment, the job becomes finalized once its been secured in time with the valid consent of all stakeholders. Hence, the threat made by your wife’s sister is not enforceable. She has no valid grounds for claiming the job or the land.

You wife’s job was legally given and cannot be taken back or transferred. Her sister has no legal right to claim it now. Also, their mother’s land cannot be divided unless the mother decides. Divya is safe and does not need to sign anything under pressure. If threatened, she can take legal action for harassment. For further legal assistance contact us on our helpline number.
