Is seniority affected by a different joining date?
I filed a WRIT petition in the honourable Allahabad High Court against the biased recomputation of the DPC. The subject DPC committee member had violated several DOPT guidelines and wrongly interpreted its promotion policy because earlier I pointed out a blunder in the work of One of the members of the DPC. My WRIT is pending to decide meanwhile I have been got promoted in subsequent DPC. Can I use the subject WRIT for the reckoning of my seniority from the disputed DPC?
In the context of administrative law, the pending writ petition challenging the earlier DPC's biased recomputation does not automatically guarantee seniority reckoning, but you can use the pendency of the writ as a strategic legal argument. Your subsequent promotion in a subsequent DPC provides additional procedural leverage. Under the principles of administrative justice, you can seek retrospective seniority by arguing that the original DPC's violations invalidate its adverse findings, thereby allowing potential correction of your seniority date.
