Can I challenge cancelled vacancies and rank list in courts?
Sir, I was included in the KPSC rank list published in February 2020, which was later cancelled in February 2023 for the post of Clerk in various Apex Cooperative institutions in Kerala. My qualifications are B.Com (Cooperation), DCA, and M.Com. My concern is that one Apex Cooperative firm reported 11 clerical vacancies to PSC in June 2020, but withdrew them after 2 months, changing the qualification to B.Com (Cooperation) & DCA. They then called for a new notification through PSC in the same year. I could not apply as I was overaged at that time. The exam was conducted, a rank list was published, but it was cancelled within 1 year. As per the latest RTI, there are currently 25 temporary employees working in the same post. I have filed a suit in the High Court, arguing that the withdrawal of reported vacancies was unjust and arbitrary. My case has been pending for 2 years. Please give legal advice on this subject. Is there any chance of getting a favorable order? If I fail in the High Court, will there be a chance in the Supreme Court?
Your case in the High Court highlights the arbitrary withdrawal of vacancies, which courts generally take seriously, especially when temporary employees are appointed instead. Since you were eligible in 2020, you have a valid ground. If the High Court rules against you, or if your case has been pending for the last 2 years, you can move the Supreme Court to direct the High Court to expedite the matter, and also cite violation of equal opportunity and arbitrary action.
