Can I sue Mobikwik for reduced cashback after KYC?
Mobikwik, a UPI platform, claims to give 5% cashback on every transaction made through their platform. I was receiving it too, but ever since I completed my KYC, I am hardly getting 1% cashback. Can I file a lawsuit, and if so, for how much?
Dear Client, a suit of this nature will not prevail, since Cashbacks are mere promotional benefits. The provider has absolutely no obligation to provide such benefits, until and unless it is imperative for performing the service.
No. As per the provisions of the Consumer Protection Act, 2019, promotional claims of such nature can be reduced or even withdrawn at any time at the discretion of the provider. Promotional claims are differentiated from the services promised by the provider. A deficiency in providing the latter only attracts penal sanction.
Sir, cashback offers often come with specific terms and conditions that can be confusing. For example, cashback may only apply to certain categories of purchases or may require a minimum spend. If users don't read these terms carefully, they might feel misled. In your case, if there is anything misleading or if you have suffered any loss, you can send them a legal notice.
