Can RTI appeal be decided after 45-day limit?

I filed an appeal before the First Appellate Authority on 21st May 2025 under the Right to Information Act, 2005. The appeal has not been decided yet. The Appellate Authority should have decided the appeal on or before 20th June 2025 or, in extreme cases, by 5th August 2025. Today, the Appellate Authority sent me a letter requesting my personal presence for a hearing on 25th August 2025 regarding my appeal dated 21st May 2025. I would like to know whether the Appellate Authority has legal authority to decide the matter beyond 45 days. Should I attend the hearing on 25th August 2025, or can I write to the Appellate Authority stating that it has no legal sanction to decide the appeal after 45 days? Please provide any relevant case laws decided by Hon’ble High Courts or the Hon’ble Supreme Court. Thanks.

The First Appellate Authority should decide your RTI appeal within 30 days but it can be extended to 45 days in exceptional cases. If delayed, you can remind them in writing and mention the legal time limit. It is advisable to attend the hearing as it may help resolve the issue faster.
