Does unpaid PGT work and reduced salary mean cheating?

As per the offer letter, the PGT post was subject to approval from higher authorities. A reduced salary was paid. When I asked for the actual appointment letter, it was refused on the grounds that the profile had not been approved by DAVCMC in July. However, I was still allowed to work and was partially paid, yet no appointment letter was ever issued. When I asked again for the appointment letter and proper salary, the principal was restrained without any notice. After filing a case, a cheque payment was made illegally. Would this not fall under criminal breach of trust or cheating? The CJM court dismissed the case, stating that it is a civil matter, especially since a writ petition has also been filed. Should we challenge this verdict, as we are seeking punishment?

The Magistrate dismissed your case because salary and appointment disputes are treated as civil matters, not criminal cheating, unless fraud from the beginning is proven. You can challenge this order in revision, but chances are limited. The stronger option is to pursue your writ petition for full salary, arrears, and service-related relief from the High Court.
