How can I unfreeze my bank account?
It has been more than four months since my account was frozen and the money is under lien. The police are not responding. How can I resolve this?
If a bank account remains frozen for over four months without law enforcement explanation, the owner has legal recourse. Police can freeze accounts under BNSS Section 106 if crime-linked, but must immediately inform a Magistrate. Failure to do so or lack of FIR/charges renders the freeze illegal. The affected person can file a High Court writ petition (Article 226) to unfreeze the account, citing violation of property rights (Article 300A), as confirmed by *Tapas D. Neogy* and *Muktaben M. Mashru*. Alternatively, if the bank is unresponsive, a complaint can be lodged with the RBI Ombudsman. Specific remedies exist for ED, Income Tax, or FEMA freezes.
If your account is frozen and police are not responding, first get a clear reason from your bank or authorities. If police remain unresponsive, file a formal complaint or approach higher officials. You can also consult a lawyer to help you file a court petition to release your funds faster. For further legal assistance contact us on our helpline number.
