How to claim compensation for unfair investigation by company?
I am working at Bandhan Bank. I resigned on 7 August 2024 and served my notice period, but just two days before my relieving date (which was 4 November 2024), i.e., on 1 November 2024, I received a letter stating that my resignation had been stopped due to certain process lapses found during my service. The investigation continued for 20 months. On 17 March 2026, the bank issued me a warning memo regarding the service lapse found after this long investigation. They have wasted nearly two years of my career, and during these 20 months, I suffered severe mental stress. My family also suffered because I am the sole earning member. How can I claim compensation for this delay in completing the investigation and for the harassment I faced during this period? This has also affected my chances of getting a better job package, as I have not received any ratings during this tenure. Kindly suggest.
Dear client, A legal notice can be sent to the bank first with a demand: release/clarification of your employment status, the service certificate, the relieving letter, and antimony for the useless delay mentioned earlier. If the inquiry terminated only with a warning memo, the holding back for 20 months could be questioned as arbitrary and unfair labour practice. You are free to approach the Labour Commissioner, lodge a civil claim against the employer for damages for harassment, loss of career and delayed acceptance of resignation. Keep all letters, emails, proof of resignation and investigation. If you have any query please feel free to contact us.
You can first send a legal notice to the bank demanding release/clarification of your employment status, service certificate, relieving letter, and compensation for unreasonable delay. If the inquiry ended only with a warning memo, holding you for 20 months may be challenged as arbitrary and unfair labour practice. You may approach the Labour Commissioner, file a civil claim for damages for harassment, career loss, and delayed resignation acceptance. Keep all letters, emails, resignation proof, and investigation documents. For further legal assistance contact us on our helpline number.
