How to respond to court notice?
I have a OneCard credit card and have been unable to make any payments for the past year due to unemployment. I am now employed and requested the recovery agent to allow me time to repay the amount by December 2025. However, they filed a case in the Kolkata Magistrate Court against me under Sections 316 and 318 of BNS. I have received a cognizance notice from the court. I have recently closed two other credit card loans and am currently collecting funds to settle this one by December 2025. How should I respond to the cognizance notice? Also, how much should a lawyer charge for one hearing in Kolkata, considering I am residing in Delhi and unable to be present in court on the given date?
You have received a court notice because the bank filed a criminal case under BNS. Don’t ignore it. Hire a local Kolkata lawyer quickly, file your appearance, and request exemption since you live in Delhi. Tell the court you are arranging repayment by December. If settlement happens, the case can be closed. For further legal assistance contact us on our helpline number.
