A person facing litigation can be the Secretary of a Residential Welfare Association (RWA) unless the bylaws prohibit it. The Societies Registration Act, 1860 doesn’t specify disqualification but Section 16 allows removal for misconduct. If bylaws are silent, members can amend rules or challenge the appointment in court. Consult lawyer for the same would be advisable.
