What action can be taken against vehicle reseller agent?

A vehicle reseller agent sold my vehicle without my authorization and misled me for two months, claiming that it was safe in his godown. When I demanded a settlement of ₹50,000, he pressured me into signing a delivery challan at his office, mentioning that ₹10,000 was paid in advance and the remaining ₹40,000 would be paid after the RTO transfer process. After signing, he paid only ₹8,000 and refused to pay the remaining ₹2,000. He later denied paying the balance. I have call recordings as proof with timestamps. What action can be taken in this case?

You can file a police complaint for cheating (Section 420 IPC), breach of trust (Section 406 IPC), and forgery if applicable, as the agent misled you and sold your vehicle without authorization. Additionally, you can send a legal notice demanding the full settlement amount and, if unpaid, file a civil suit for recovery along with compensation for mental harassment. Your call recordings serve as strong evidence to support your case.

As your reseller agent has sold your vehicle without your permission so you can file a complaint under section 316 of Bhartiya Nyay Sanhita for the criminal breach of trust for the transfer of your property without your permission and has made a breach of trust .

Sir, you can file an FIR with the police for fraud and criminal breach of trust, providing evidence like call recordings and the delivery challan. Additionally, you may file a civil suit for breach of contract to recover the remaining ₹2,000 and compensation with the help of an expert lawyer who will assist you with the best course of action.
