What are valid ground of divorce?
My husband, Divij, stayed in a hotel room with a girl before our marriage. Initially, he said they were just friends, but later he claimed that nothing happened between them. However, there are many nude photographs. Can this be considered a valid ground for divorce?
Dear client, Premarital relationships alone are usually not a valid ground for divorce. However, if there was fraud, concealment of facts, cruelty or adultery. After the marriage, it may become a ground for divorce, depending on the evidence and circumstances being presented. May this help and you have any further issues do not hesitate to contact us.
Acts done before marriage are generally not valid grounds for divorce. However, if your husband hid a past sexual relationship or misrepresented facts that were important for your consent, it may amount to fraud/misrepresentation, which can be a ground to seek annulment of marriage (not divorce). If his conduct continues after marriage (affair, mental cruelty, humiliation), you can file for divorce on grounds of cruelty or adultery. Nude photos alone must be legally proved and relevant. Consult a family lawyer, preserve evidence, and evaluate whether to file for annulment or divorce based on facts. For further legal assistance contact us on our helpline number.
