What happens if FIR not investigated for 40 days?
MLC FIR 0249 is not being investigated. Already 40 days have passed. Is it possible for the accused to get bail by default? What can I do? I have already complained to the SP and DC, but the issue has not been resolved.
If the police are delaying the investigation for over 40 days, you can file an application before the Magistrate to direct the police to investigate. If there is a risk of the accused getting default bail, your lawyer can oppose it by showing that investigation is still pending. You may also file a writ petition before the High Court to ensure a fair and timely investigation. For further legal assistance, contact us on our helpline number.
