When executive petition is filed?
I filed an execution petition for arrest for verification purposes. If the court refuses the arrest of the judgment debtor and disposes of the petition, can I file a fresh execution petition?
Dear client, an execution petition is being filed after the decree or judgment is passed to enforce it, such as recovery of money or arrest of the judgment debtor. And yes, if your execution petition is disposed of without any full satisfaction of the decree, you can file a fresh execution petition, as long as the decree is still valid and not fully executed or time barred. I hope this answer your query, for further queries contact us.
A fresh execution petition is maintainable under the Civil Procedure Code, 1908 if the earlier petition was dismissed on technical grounds or for verification. However, if it was dismissed on merits, a fresh petition is generally not allowed unless there is a new cause or change in circumstances. Always check the court order before refiling.
