Will I need evidence and a lawyer for a forgery case?

Hi, we recently closed a case by compromise with my aunt's family and submitted a sketch of the parts given to them in agricultural land to the court. My aunt's family had the sketch prepared by the government surveyor and got the land transferred to their name. However, I found that my aunt's family forged my signature on the survey sketch document and changed it from what we had agreed upon in court. I plan to lodge a police complaint for forgery, but I have a few questions: 1. Will I be responsible for providing all required evidence after filing the complaint? 2. Will I be responsible for hiring a lawyer to fight this case in court, or will a Public Prosecutor appear for me? 3. If my aunt's family wants to compromise with us to withdraw the case, will I be able to close the case?

After filing the police complaint, the police will investigate and collect evidence, but providing any supporting documents can strengthen your case. Since forgery is a criminal offense, a Public Prosecutor will handle the case, though you can hire a private lawyer if needed. As forgery is non-compoundable, the case cannot be withdrawn without the court’s permission, but a settlement may influence the proceedings.

In civil cases as per section 104 of CPC the burden of proof lies on the person who claims that a certain fact is true and it is their responsibility to prove their facts , so in this case it is your responsiblity to prove the facts .you shoud hire a lawyer to hire this case , and if your aunt family wants compromise to resolve this case then it would be a better option so that you shoud not invlve in unnecessary and lenthly case trial.

Sir, you will need to provide evidence after filing the police complaint for forgery, including proof of your signature and the original documents. You’ll generally need to hire a lawyer, as the Public Prosecutor typically represents the state. If your aunt's family agrees to a compromise, you can withdraw the case by filing a petition with the court, which, if approved, can lead to closing the case.
