Can nominee claim money from two insurers after death?
A person has two vehicles, each with ₹15 lakhs accidental insurance. One policy is with United India Insurance (government) and the other with Acko General Insurance (private sector). In case of accidental death, can the nominee claim ₹15 lakhs from both insurers? Has anyone in a similar situation gone to court after repudiation and received the claim in India?
Dear Client, In the event of accidental death, your nominee can lawfully claim the full ₹15 lakhs under each valid policy, because personal accident insurance is treated as a benefit policy, it pays the fixed sum assured on the insured event regardless of multiple covers, unlike indemnity policies that only reimburse actual loss; therefore, both United India and Acko are liable to pay their respective sums if the policy conditions are met, and Indian courts, including the NCDRC, have upheld such multiple recoveries in similar cases, so your nominee should be advised to proceed confidently with claims under both policies. I hope this answer helps you. For any further queries, please do not hesitate to contact us. Thank you
Yes, the nominee can claim from both insurers because accidental death insurance is benefit-based and not reimbursement-based. This means each insurer has to pay the insured amount independently. Courts in India have upheld such claims, and IRDAI has not restricted multiple payouts. If any insurer repudiates, you can approach the Insurance Ombudsman or file a case in Consumer Court for relief. For further legal assistance contact us on our helpline number.
