Can Bank legally harass me for credit card recovery?
The HDFC Bank credit card department is harassing me every day regarding my credit card payment. I have repeatedly requested them to waive the penalty charges, but they have refused to do so. What legal remedy is available in this situation?
Dear Client , If the bank or the bank's recovery agents are harassing you, you should first file a written complaint with the bank for resolution and waiver of charges, if they believe it is appropriate. If the grievance continues to be unresolved, one can request the bank to advance it to the bank's internal grievance mechanism and subsequently the Reserve Bank of India (RBI) Integrated Ombudsman Scheme (if applicable). In case such recovery practices are abusive and/or contravene applicable RBI guidelines, you may also approach the concerned forum for suitable remedies. In most cases, however, for them to grant you a waiver of penalty charges, you must follow their bank policy and contractual requirements. Thank you for reaching out to Prime Legal.
If you are facing continuous harassment from the credit card recovery department, ask the bank to provide a written statement of your outstanding dues and the penalty charges. Submit a written request for waiver of the penalty, along with the reasons. If the bank continues to harass you or acts unfairly, you may file a complaint through the bank's grievance mechanism and, if necessary, approach the appropriate regulatory or legal forum.
