What legal action can I take for non-delivery after advance payment?
Quotation and Deal: The agreement was made with Mr. Ajay Tanwar from the Aurangabad branch of M/s DRS Dilip Roadlines Ltd. for shifting household goods, including packing and loading/unloading, for Rs. 150,500/- including GST. Dispatch and Loading: M/s DRS group sent a team with branded truck no. MH20EL1569 on 22.03.2024 to load all household goods and a Honda scooty (MH20GM0479) with DRS branding. The item list and Consignor copy (GC no.4873065) were handed over. Advance Payment: Mr. Ajay Tanwar insisted on 100% advance payment, which was made on 25/03/2024, based on the provided bank details. However, it's now apparent that the branch manager shared fraudulent bank details. Non-Delivery and Fraud: Despite payment, the goods have not been delivered, and M/s DRS is requesting payment again. This constitutes a breach of contract and fraudulent behavior.
Since the advance payment was made based on fraudulent bank details and the goods have not been delivered, you can file a legal complaint for breach of contract and fraud under the Indian Contract Act. You may also seek a refund and compensation through consumer court or a civil suit. For further legal assistance contact us on our helpline number.
