What legal action can be taken against domestic violence?

My wife Shaheen Bano is a victim of domestic violence in Barabanki, Uttar Pradesh. The respondents are six family members. The incident occurred on 02.08.2025. A private criminal case under BNS Section 173 is already pending in the Barabanki court. The DLSA refused free legal aid, stating that an FIR is required. The police are not registering the FIR despite three complaints to the SP. The Protection Officer has also refused assistance. I urgently need free legal aid for filing an application under Section 12 of the Domestic Violence Act.

Dear client, you can file an application under section 12 of the Protection of Women from Domestic Violence Act 2005 directly before the magistrate, even if no FIR is registered. You may also approach the court under section 175(3) of BNSS to seek directions for FIR registration and request free legal aid again from DLSA along with the court documents and complaint copies. May this help and you have any further issues do not hesitate to contact us.

Dear client, You can go to the District Legal Services Authority again. Ask for free legal help under the Legal Services Authorities Act of 1987. The District Legal Services Authority can provide you with legal aid under the Legal Services Authorities Act of 1987. You do not need to file a First Information Report to apply for help under the Domestic Violence Act Section 12. You can also go to the Magistrate Court directly. The Magistrate Court can help you with protection and a place to stay. The Magistrate Court can also order maintenance relief for the Domestic Violence Act. If you have any query please feel free to contact us.

You can directly approach the District Legal Services Authority (DLSA) again and insist on free legal aid under the Legal Services Authorities Act, 1987; FIR is not mandatory for DV Act Section 12 application. You can also approach Magistrate Court directly, which can order protection, residence, and maintenance relief. For further legal assistance contact us on our helpline number.
