Can contempt action be filed for non-compliance of court order?
The petitioner retired in 2021 and filed a CWJC before the Patna High Court in 2024. In December 2025, the Court directed the petitioner to submit the required documents to the DDC within four weeks and directed the DDC to release the payment within eight weeks thereafter. The petitioner fully complied with the Court's order, submitted all required documents, made multiple representations, and informed the DDC about his financial hardship and his wife's pending surgery. The DDC verbally assured compliance but neither released the payment nor issued any written response. More than six months have passed, and the payment remains unpaid. The petitioner subsequently wrote to the Commissioner and Chief Secretary and later informed the DDC of his intention to file an MJC/Contempt Petition seeking compliance and interest, while also enclosing the relevant judgment in support of his claim. Within one week of receiving the contempt notice, the DDC, without any direction from a superior authority, constituted a three-member Enquiry Committee to re-audit accounts relating to 2021 and earlier periods, despite the audit having already been completed and the report having been submitted in 2023. In these circumstances: 1. Does the DDC's failure to comply with the High Court's order amount to contempt of court? 2. Can the formation of the Enquiry Committee immediately after the contempt notice be considered victimization or retaliation? 3. Is the re-audit legally sustainable when the matter had already been audited and settled? What legal remedies are available to seek payment with interest, initiate contempt proceedings, challenge the enquiry, and recover litigation costs?
If the High Court directed payment and the petitioner fully complied, continued non-payment may provide grounds for initiating contempt proceedings. The petitioner may file an appropriate application before the Patna High Court seeking compliance, interest on delayed payment, and other reliefs.
