Can employer sue me for starting LLP in same industry?
I am currently working with an organization in Gurugram, Haryana, and serving a client based in California. I have recently established my own LLP in the same industry but will not target my current employer’s client. I had signed a non-disclosure, non-solicitation, and non-compete agreement at the time of joining. Can my employer sue me? If yes, how can I legally protect myself?
Even if you are not targeting your current employer’s client, they may still claim a breach of the non-compete clause. Courts in India usually do not enforce such clauses after employment ends. To protect yourself, avoid using company data or contacts. Consult a lawyer to review your agreement and structure your LLP safely. For further legal assistance contact us on our helpline number.
