I resigned but was still employed during the layoff date. Can I get compensation?
I worked for an MNC for over 15 years and submitted my resignation on 10th November 2022. Within two weeks, I asked the HR team to withdraw my resignation. The notice period is 90 days. On 23rd January 2023, the company announced a layoff compensation policy, stating that only employees working up to 23rd January 2023 are eligible—excluding those in the notice period. My resignation was accepted on 8th February 2023, and I was relieved on 28th February 2023. Juniors with fewer years of service received the compensation.
You can take legal action since your resignation was accepted after the compensation date. File a case in the Labour Court or Civil Court seeking layoff compensation. Your resignation withdrawal and service records prove you were eligible. The policy seems biased and can be challenged legally. For further legal assistance contact us on our helpline number.
