How many times an IO can be changed?

How many times can an Investigating Officer (IO) be changed in a criminal case by any party, if an ASP-level IO is involved? In a case filed by Company A against the employees of Company B, Company A has requested a change of the IO four times already. How can we stop this, and what is the legal limit for requesting an IO change according to Rajasthan police law?

The law of Rajasthan does not place any definite time limit for how many times the Investigating Officer (IO) can be changed in a criminal case. But any request has to be accompanied by cogent reasons, supported by the approval of the supervisory officer and a detailed speaking order regarding the same, if the change is allowed. You can file an application to the supervisory authority stating that the repeated requests for changes by Company A disrupt the investigation process and lack justifiable grounds. This may help maintain the integrity of the investigation.

There is no specific legal limit in Indian law or Rajasthan police regulations on the number of times an Investigating Officer can be changed. However, you can challenge frequent IO changes in court under Section 156(3) CrPC by filing a petition that highlights how these changes are deliberately delaying the investigation and requesting that future changes require court permission.
