What legal action action can be taken against unpaid salary?

My company has not paid me my salary for the last 5 months. When I ask them about it, they just say it will be paid within a month or next week, but it never happens. I now believe they are shutting down their business within a month, as they are already in a lot of debt. I have all the necessary proof and documents ready. Can someone please help me with what actions I should take to get my money? I would prefer not to go to court, but I want to take action that will pressure them to release my salary. They are also very afraid to show their financial records because they have committed a lot of fraud, so we might be able to leverage that.

If the company is not paying you your salary and it becomes debt for last five month and you donot want to go to court in that case you can make an application to the employer or the HR to make the payment otherwise serious actions can be taken against him . or you can moveto the NGO who are working for the employees rights at workplace,aor you can take help of lawyer and make a notice with the help of lawyer , but if you can take a legal action against the employer it would be more benefitial for you .

Write a formal letter to your employer requesting immediate payment for the outstanding salary amount owed and set a deadline for a response. In case this fails to produce a positive outcome, then send them a legal notice requesting payment and reminding them that legal action can be taken, thus putting them in pressure. One can even complain at the labor department or can get the help of the labor court for settlement. If they are doing something fraudulent, then this will make your case stronger. Organize all your documentation to present your case well.
