What legal action can be taken against illegal termination?

Hi, I would like to know what case we can do on the company if they get work from you for 18 months and at last due to personal grudges they rolled you back on last designation but your performance is top class. What can I do?

If you have faced unfair demotions for personal revenge and you, despite your superb performance, believe you have cases for legal suits. First look at your contract to see the clause on such an action. If the process of demotion was not condoned or you weren't consulted to do so then you can proceed to claim Constructive Dismissal, thereby saying that employment was breached from the employer end. Under Indian labor laws, if your demotion was unfair or arbitrary despite consistent top performance, you may file a case for unfair labor practice under the Industrial Disputes Act, 1947 or approach the Labour Court/Tribunal. Additionally, if your employment contract or company policy was violated, you can consider a civil suit for breach of contract.
