Can advance money be recovered through consumer court without agreement?
Hello. I am from Bangalore, India. For a franchise association, I paid ₹1 lakh as an advance to a business based in Hyderabad. No written MOU or agreement was provided for this amount, though it was demanded by them. Due to unsatisfactory terms and responses, the proposal did not proceed. When I requested a refund, they refused and insisted on adjusting the amount against products. Even requests for partial adjustment and partial refund were rejected. To reduce losses, I placed an order for some products, but they had serious labelling violations and poor quality. They did not respond to my legal notice, NCH complaint, or FSSAI grievance. Is this a valid case to file through the e-Daakhil Consumer Forum, and how should I proceed for faster recovery?
Yes, this is a valid consumer dispute. Even without a written agreement, payment proof and communications are sufficient. You can file a case on the e-Daakhil Consumer Forum for deficiency of service, unfair trade practices, and refund with interest. Non-response to legal notice, NCH, and FSSAI strengthens your case. Consumer court is the fastest recovery option. For further legal assistance contact us on our helpline number.
