How can I legally recover my money?

I live in Pune and was sharing a flat with my roommate. The actual rent for the flat is ₹13,000, and the deposit is ₹12,000 (confirmed directly from the real owner). However, my roommate hid this information and told me that my rent share was ₹11,000 per month. I paid her ₹11,000 for 4 months (₹44,000 total). My actual share should have been ₹6,500 per month, so I have overpaid ₹18,000. She also took ₹15,000 as a deposit from me, and one EMI of ₹1,481 from my credit card remains unpaid. In total, she owes me ₹27,481. I have GPay proofs of all payments. She also made someone pretend to be the “owner” on a call, proving she misled me knowingly. What is the best legal way to recover my money — should I file a money recovery case or a complaint under IPC Sections 420 and 406?

You can first send a legal notice to your roommate demanding repayment of ₹27,481 within 15 days. If she fails to return the money, file a money recovery case before the Civil Court or under Section 318 (cheating) and 316 (criminal breach of trust) Bhartiya Nyaya Sanhita 2023 in the local police station, using your GPay and call evidence as proof.
