What to do if land fraud case stays pending in court?
A group of people cheated me by selling land belonging to another person. An FIR has been lodged against them in PS Kalyanpur, Kanpur Nagar, Crime Number 04/2025. The accused obtained a stay on arrest on the grounds of mediation (CR WRIT 1070/2025). Due to pendency in the Hon’ble Allahabad High Court, the case is still pending. A stay vacation application and counter affidavit were filed in time. I have consulted more than five learned counsels, and all advised that the police must submit the charge sheet.
Even if the accused got a stay on arrest, police must still investigate and file the chargesheet. Stay only protects them from arrest, not from investigation.
