Can employer force notice period without signed agreement?
My employer accepted my resignation but sent me a legal notice asking me to either serve a 1-month notice period or pay one month’s salary and their legal expenses. They’ve already withheld my one-month salary. They also falsely accused me of sharing confidential data and are threatening me to delete my Google review about them. What can I do?
If you did not sign a contract with a 1-month notice clause, they can’t legally enforce it. You can respond to their notice stating this and file a complaint with the Labour Commissioner for withheld salary. They can’t threaten or force you to remove a genuine review—this can be reported as harassment. For further legal assistance contact us on our helpline number.
