Can I break bond if salary unpaid and office closed?
Can I break the employment bond because I haven’t received my salary for the past three months, and there has been no functioning office for the last two months? During this time, I searched for a new job and received an offer. Now, when I want to join the new company, my current employer is calling me back to the office. If I leave the company, he is asking me to pay the bond amount of ₹2 lakhs. At the time of signing the bond, we gave two cheques of ₹1,00,000 each. He said he would deposit them, and if they bounce, he would file a civil case against me. Is there any way to get out of this issue, especially considering that he spent only ₹32,000 on my training?
Yes, you have strong legal grounds to challenge the employment bond. Since your employer did not pay salary for 3 months and had no functional office for 2 months, the bond becomes unfair and likely unenforceable. Cheques given as security are not valid for criminal cases. You can send a legal notice, stop cheque payment, and file a complaint for unpaid wages.
