Is notice period valid if no employment contract signed?
I joined an organization two months ago. Until now, I have not signed any employment agreement; they only issued an offer letter. As per the employment letter (which I haven’t signed), I am required to serve a 90-day notice period or pay 90 days’ salary if I resign or abscond. Since I haven’t signed any employment letter, is this condition still applicable to me? If I resign and leave today, can the company legally recover 90 days' salary from me?
If you have not signed the employment agreement, the 90-day notice period clause may not legally apply. However, companies can argue that you accepted the terms by continuing work. Still, without your signature, it’s harder for them to enforce. Resigning without notice could affect your reputation, but legal recovery is unlikely.
