What are my rights after 40% locomotor disability certification?
I am working in a Central Government organization, and my job is physically demanding in a remote forest area in Northern India for about 10 months a year. I have completed around 20 years of service. Due to the physical strain, I developed osteoarthritis. On August 29, 2025, I underwent a medical assessment and was diagnosed with 40% temporary locomotor disability. I have been representing my case for the past two years, but they continue to assign me field duties. That’s why I decided to get a disability certificate. What steps can my office legally take against me now? And what should I do if they fail to assign me a suitable role or reasonable accommodation? Please suggest a way forward.
You are legally entitled to a lighter or desk job under the Rights of Persons with Disabilities Act. Submit your disability certificate and request a suitable role. If your office doesn’t help, you can complain to the Disability Commissioner or approach the Central Administrative Tribunal (CAT) to protect your job and health.
