What legal risk exists after withdrawing cyber complaint, amount frozen?
I made an online purchase through Instagram and paid via UPI. Due to delay and lack of tracking details, I filed a cyber complaint. Later, the seller claimed the product was dispatched and requested me to withdraw the complaint. I have withdrawn it online, but the bank amount is still frozen. The seller says her lawyer advised that the situation may worsen if I do not submit a written application at the police station. What legal risk, if any, do I face?
Dear Client, you will not face any liability just because you withdrew the complaint as it was in good faith. The amount may still be frozen because the complaint closure has not yet been processed. Sometimes the police, cyber cell, or bank may ask for a written application or confirmation before taking further action. Before giving any written statement, make sure the product has actually been delivered or that the dispute has genuinely been resolved. Keep copies of all chats, payment details, tracking information, and complaint records. If the police or cyber cell contacts you for a statement or confirmation, cooperate and provide accurate information
Dear Client, if your father has already been convicted and sentenced, the usual next step is to file an appeal in the higher court against the conviction. Along with the appeal, his lawyer can also request the court to suspend the sentence and grant bail while the appeal is pending. Bail after conviction is not automatic, especially in serious cases. The court will look at the judgment, the evidence, and the grounds raised in the appeal before making a decision. You should obtain copies of the judgment and sentencing order and speak to a criminal lawyer as soon as possible so that the appeal and bail application can be filed without delay. I hope this helps. Once you have withdrawn the cyber complaint online, there is generally no criminal liability if your intention was bona fide. However, banks often require a written closure request or police NOC to unfreeze the amount. You should submit a written application to the concerned police station and follow up with the bank. No legal risk arises if facts were genuine. For further legal assistance contact us on our helpline number.
