How to claim compensation for damaged earbuds and emotional distress?

I reside in Patna, Bihar, India. My Rs. 800 earbuds were taken without my permission and returned in poor condition. I refused to accept them and asked for a replacement. I was promised a replacement in 3 days along with compensation. I reminded the person daily for 5 months, but I received nothing. I needed the earbuds for movies, gaming, and socializing online. The emotional distress was significant. The person had no reason to take them. My father had to buy a replacement. The person, who has no financial issues, refuses to provide fair compensation. Their offer of Rs. 1600 is inadequate. The compensation should cover the stolen item, additional expenses, inconvenience, emotional distress, and the time spent pursuing a resolution. Remember, multiple promises were made, but none were fulfilled. He owns headphones worth over Rs. 10,000 and had no reason to do this. This was just done to upset me. Please calculate the compensation amount he should pay, considering all the inconvenience caused to me.

In this situation, you can approach a consumer court for compensation. File a case for the damage to your earbuds, emotional distress, and inconvenience caused. In addition to the replacement value of the earbuds, claim compensation for the promises made but not fulfilled, including your time and the mental distress caused due to the delay.
