Is land conversion cancellable if cottages sold as residential layout?
Land measuring 10 acres was converted for commercial (resort) purposes, and a single plan approval was granted. Later, through corruption with panchayat officials, the landowner obtained multiple PIDs for this 13 acres and sold more than 20 cottages to different individuals. Although the land is still being used for resort operations, is it possible to approach KAT to request cancellation of the conversion since the conditions of conversion were violated and multiple PIDs were created, with cottages being sold as a residential layout?
If the land was converted for resort use but later misused by creating multiple PIDs and selling cottages as residential plots, you can challenge this. You can file a complaint with the Deputy Commissioner or approach the Karnataka Appellate Tribunal (KAT) to cancel the conversion. Since conditions were violated, the conversion can be revoked, and action may be taken against those involved. For further legal assistance contact us on our helpline number.
